1. Acceptance of Terms

By accessing or purchasing from www.finessepop.com, you confirm that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, please do not use the site or place an order.

These Terms apply to all visitors, customers, and anyone who accesses or uses our website, products, or services. FP COM LLC reserves the right to update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.


2. About Finesse Popular

FP COM LLC is a minority woman-owned, limited edition sleepwear brand based in Virginia Beach, Virginia. Every piece is handmade by Caribbean artisans using premium factory overrun fabrics. Our designs are produced in small batches and are never restocked or repeated once a fabric roll is depleted.

We operate exclusively through our direct-to-consumer website at www.finessepop.com.


3. Products and Limited Edition Policy

All Finesse Popular products are limited edition by nature, not by marketing. This is a structural feature of our business model. When a fabric roll is exhausted, the corresponding design is permanently retired to the archive. It will not be restocked, reproduced, or made available again under any circumstances.

By placing an order, you acknowledge and accept the following:

  • Product availability is not guaranteed beyond the point of your completed purchase.

  • Retired designs cannot be reordered or reproduced.

  • Unit counts displayed on product pages reflect actual availability at the time of viewing and may change without notice.

  • Product photography reflects real colors and patterns; minor variations in digital display settings are not grounds for return.

Lounge Kits include a sleepwear set, a designer sock, and a nylon mesh travel pouch, delivered in an Art Box. All components are required for return eligibility.


4. Pricing and Payment

All prices are listed in United States Dollars (USD). Finesse Popular does not participate in phantom sales, fictitious MSRPs, or semi-annual liquidations. The price you see is the price the product is worth. This is our Price Integrity Pledge.

We accept all major credit and debit cards and any payment methods displayed at checkout. Payment is processed at the time of order placement. By submitting your payment information, you represent that you are authorized to use the payment method provided.

Sales tax is applied where required by Virginia state law and applicable state regulations.


5. Order Processing and Confirmation

Orders are processed within 1 to 2 business days of payment confirmation. You will receive an email confirmation at the address provided at checkout. This confirmation does not constitute a guarantee of shipment if an item becomes unavailable due to inventory depletion between the time of order and fulfillment.

In the rare event that an ordered item is no longer available at the time of processing, you will be contacted directly by our team within 60 minutes of discovery during business hours. A full refund or alternative will be offered immediately.

Finesse Popular reserves the right to cancel any order at its discretion, including orders suspected of fraud or policy abuse, with a full refund issued to the original payment method.


6. Shipping and Delivery

All orders are shipped to the address provided at checkout. You are responsible for ensuring that your shipping address is accurate and complete. Finesse Popular is not liable for orders delivered to incorrectly entered addresses.

Estimated delivery times are provided at checkout and are not guaranteed. Shipping timelines may be affected by carrier delays, weather, or other conditions outside our control. Finesse Popular will provide tracking information once your order has shipped.

Risk of loss and title for all items passes to you upon delivery to the carrier. If your package is lost in transit, contact our team directly. We will work with the carrier to resolve the issue promptly.


7. Returns, Exchanges, and Defect Protection

The 30-Day Unwind Guarantee

You have 30 days from the date of delivery to return or exchange eligible items. Items must be unworn, unwashed, and returned in their original packaging with tags attached. Return shipping is covered by Finesse Popular.

Size exchanges are fulfilled on the same design if units remain available. If the design has been archived, a full refund to your original payment method will be issued within the 30-day window.

Lounge Kits must be returned complete, including the designer sock and travel pouch, inside the original Art Box, to qualify for a full refund.

The 365-Day Defect Protection

Every piece is backed for one full year against manufacturing defects. Qualifying defects include:

  • Seam separation or stitching failure

  • Fabric structural breakdown not caused by improper care

  • Loss of shape or structural integrity under normal wearing conditions

  • Color fading under standard washing conditions

The following do not qualify under defect protection:

  • Damage caused by improper care, abrasive surfaces, or harsh detergents

  • Items outside the 365-day coverage window

After the 30-day return window closes, defect replacements are fulfilled at equal or lesser value. To activate your protection, contact our team directly. One message. No forms. No runaround. The affected item must be returned to our studio for inspection. If the defect originates from our construction, we replace it immediately.

This is not a warranty. It is a statement of confidence in what we make.


8. Intellectual Property

All content on www.finessepop.com, including but not limited to product designs, photography, copy, graphics, logos, and the Finesse Popular brand identity, is the exclusive property of FP COM LLC and is protected under applicable United States intellectual property laws.

You may not reproduce, distribute, modify, display, or create derivative works from any content on this site without the express written consent of FP COM LLC. Unauthorized use of our intellectual property will be pursued to the full extent of the law.

Our limited edition prints and design patterns are proprietary creative works. Any attempt to replicate, reproduce, or manufacture similar designs for commercial purposes constitutes infringement and will be treated accordingly.


9. Prohibited Conduct

By using this site, you agree not to:

  • Use the site for any unlawful purpose or in violation of these Terms

  • Attempt to gain unauthorized access to any part of the site or its related systems

  • Submit false, misleading, or fraudulent orders or payment information

  • Resell or commercially redistribute Finesse Popular products without written authorization

  • Use automated tools, bots, or scrapers to access site content or inventory

  • Harass, threaten, or harm our team, partners, or community members

  • Misrepresent your identity or affiliation with any person or entity

Finesse Popular reserves the right to refuse service, cancel orders, or terminate access for any user found in violation of these terms.


10. Disclaimer of Warranties

FP COM LLC provides this website and its products on an "as is" and "as available" basis. While we stand behind the quality of every piece we make and back it with the 30-Day Unwind Guarantee and 365-Day Defect Protection, we make no additional warranties, express or implied, beyond what is stated in these Terms.

To the fullest extent permitted by applicable law, FP COM LLC disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of viruses or other harmful components.


11. Limitation of Liability

To the fullest extent permitted by the laws of the Commonwealth of Virginia, FP COM LLC, its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this site or our products, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or your use of our site shall not exceed the total amount you paid for the specific order giving rise to the claim.

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.


12. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Virginia Beach, Virginia.


13. Dispute Resolution

In the event of a dispute, claim, or controversy arising out of or relating to these Terms or your purchase from Finesse Popular, we encourage you to contact us directly first. Our team resolves most issues within one business day.

If a resolution cannot be reached informally, disputes shall be resolved through binding arbitration in Virginia Beach, Virginia, in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FP COM LLC.

Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.


14. Privacy

Your use of this site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our site, you consent to the data practices described in our Privacy Policy. We do not sell your personal information to third parties.
